...They document that at some point from 2008–2013, of the “10.1% of Michigan residents under emergency management, 70.7% were African American and 7.3% were Hispanic or Latino,” noting that while African Americans make up only fourteen percent of Michigan’s population, “51% of African Americans in Michigan were under an emergency manager.” They further explain that during the same period, “only 2.4% of Whites were under emergency management, although they make up 76.6% of the population.” The disproportionate impact of emergency management on communities of color provided the basis for the Center for Constitutional Rights to challenge the state law establishing the process of emergency management in 2017 as a violation of the Equal Protection Clause of the Fourteenth Amendment...
