Center for Constitutional Rights Senior Managing Attorney Shayana Kadidal will be arguing before the Court of Appeals for the D.C. Circuit in Ali v. Trump.

Abdul Razak Ali (aka Saeed Bakhouch) has never been charged with a crime and is one of 40 men who remain detained at Guantánamo after more than a decade. He is one of 11 petitioners that collectively filed the first major challenge to the Trump’s administration’s Guantanamo policies in January 2018. Ali v. Trump proceeded before a district court judge who denied his motion for relief in 2018.

The argument will focus on whether the Due Process clause of the Constitution applies at Guantánamo, and whether Ali’s continuing non-criminal detention for more than 17 years violates substantive and procedural due process.

Note: Oral argument will take place in Courtroom 31 in the Court of Appeals before Judges Rogers, Millett, and Randolph. Hearings begin at 9:30 AM, and Ali will be the first case to be heard.
