CCR Senior Staff Attorney Darius Charney will speak on a panel about the recent Floyd v. City of New York class action lawsuit and decision. Dialogue will include responses to questions about what constitutes reasonable suspicion, unlawful discrimination, disparate treatment by police, and more.

Issues to be considered

  • Can the police stop motorists or pedestrians without reasonable suspicion? 
  • What constitutes reasonable suspicion?
  • If police stops disproportionately affect a particular minority group, is that illegal discrimination, without more?
  • What is the appropriate comparison for determining disparate treatment? 
  • If the police are targeting particular high-crime areas, should the comparison be to the racial composition of those areas or to the larger community?
  • How can police discretion be appropriately limited without losing crime-deterring effect?
  • How should police stops in a public housing project be treated?
  • If police stops do not result in significant arrests, should that lead to curbing such stops?
