This federal class action lawsuit was filed on behalf of the Vulcan Society, the fraternal organization of Black firefighters, and three individual Black firefighter applicants charging the New York City Fire Department (FDNY) with racially discriminatory hiring practices.

The City has appealed two landmark rulings of the federal district court in the Vulcan Society Inc. v. City of New York lawsuit, both the January 2010 decision finding the City liable for a 40-year pattern and practice of intentional discrimination against black applicants for New York City firefighter jobs, and an October 2011 injunction which placed the City under the supervision of a Court Monitor for 10 years and ordered that the City make sweeping changes to its entire firefighter hiring process- from recruitment through post-civil service exam background investigations of applicants- as well as its Equal Employment Opportunity office to ensure that the FDNY complies with state and federal equal employment law.  In addition, our side has appealed the district court’s January 2010 ruling dismissing the claims of intentional discrimination that we brought against Mayor Bloomberg and the Fire Commissioner as individuals. All three of these issues will be argued before the U.S. Court of Appeals for the Second Circuit on June 26.
